Identify the exact coverage issue
A useful review begins with the complete denial letter, not a summary of a telephone call. We compare each stated reason with the available policy documents and the factual record. Matters may involve a disputed loss, an alleged misrepresentation, a policy condition or a disagreement about an exclusion.
Where appropriate, we can request clarification, identify records that have not been addressed and prepare a reasoned reconsideration submission. New evidence should be tied to the point it actually proves.
Choose the right review pathway
An internal management review, an insurer complaint, an external ombudservice process and a court claim serve different purposes. We explain which route may address the issue, what information it needs and what remains outside that route’s authority.
FSRA considers possible breaches of requirements it oversees; it does not act as your lawyer or decide your entitlement to a claim payment. A regulatory complaint should not be presented as a substitute for obtaining an enforceable coverage remedy.
Protect the deadline while considering the options
Do not assume discussions with an insurer preserve a right to sue. We consider the relevant dates and the need for separate limitation advice before relying on an informal review process.
If litigation is appropriate and falls within authorized paralegal scope, a separate retainer can address the claim, evidence and court process. Where a matter requires a lawyer or another forum, that limitation should be identified early. No reconsideration or court outcome can be guaranteed.
Questions about this service
Can a denied claim be reconsidered?
A review may be available, but its value depends on the facts, policy and reasons for denial. A useful submission identifies a specific error or evidence requiring attention.
Will a complaint pause the court deadline?
Do not assume that it will. Obtain advice on the applicable deadline and any valid agreement or rule affecting it.
