LOOK AT THE BASIS, NOT JUST THE CONCLUSION

Technical evidence needs context.

An engineering report, event-data analysis or key examination may become central to a coverage dispute. We help identify what the report says, what it assumes and what supporting material is needed for a meaningful legal response.

Understand the material being relied on

A short description of a technical conclusion is not the same as the full report. We can help request relevant supporting material and organize the report alongside photographs, vehicle details, inspection dates and the factual chronology.

Questions may concern the method used, the condition of the vehicle, the identification of a component or key, the time period captured by data and limitations acknowledged by the author. The significance of each issue depends on the particular evidence.

Separate technical interpretation from legal analysis

Our role is to review how technical material is being used in the legal dispute. We do not claim to be engineers, vehicle examiners or forensic specialists. Where independent expertise is needed, a suitably qualified expert should assess the technical question.

A response can identify a factual mismatch, an unanswered question or a limitation in the material without asserting an unsupported technical theory. Alternative explanations should be treated as possibilities unless the evidence establishes them.

Preserve the underlying evidence

Retain original reports, photographs and data files. Keep a record of who inspected the vehicle, when it was inspected and any changes made after the loss. Seek advice before destructive testing or disposal of potentially relevant components.

Where litigation is contemplated, disclosure requests and any expert involvement must fit the applicable process and retainer. A request for documents does not establish that the insurer is legally required to provide every item requested.

Have a deadline? Include the date in your initial inquiry. Do not assume a consultation request, negotiation or complaint pauses a legal deadline.

Questions about this service

Do you provide an independent engineering opinion?

No. Legal review and technical expert opinion are different services. An independent expert may be needed.

Does one unanswered technical question invalidate a denial?

Not necessarily. The question must be assessed in context with the policy, the complete evidence and the insurer’s stated reasons.
